DPP Seeks Extradition of US-Based Suspects in Shocking Family Murder Plot

The Director of Public Prosecutions (DPP) has moved to have two suspects accused of conspiring to murder five members of their family extradited from the United States.

The DPP told the court that arresting the couple has been difficult since they live abroad, yet they face the same charges as their father in the alleged murder-for-hire plot.

At the center of the case is 72-year-old Francis Muya, identified as the main suspect, who faces five counts of conspiracy to murder. His daughter and her fiancé, both residing in the US, are also wanted on the same charges.

According to the charge sheet, Muya allegedly conspired with others between March 1 and May 2, 2024, hiring hitmen at a cost of more than Ksh3 million to eliminate his estranged wife, Rose Njeri Muya.

He also faces four additional counts of plotting to kill their children – Antony Mwaura, Martin Muya, Alex Muya, and Oprah Muya.

Prosecutor Seeks Warrants of Arrest

When the matter came up for hearing, prosecutor Joseck Abwajo told the court that the prosecution would seek arrest warrants for the couple living in the US.

He explained that the State would also work with Interpol to have the suspects arrested and extradited to face seven charges in Kenya.

The prosecutor noted that the case, which had stalled for more than a year, was now ready to proceed. The long delay had triggered protests from the victims’ side.

The victims’ lawyer, Mbugua Macharia, welcomed the extradition request, saying one of the reasons the case had dragged on for so long was that it took long to prefer charges against the couple.

“We support plans to issue warrants of arrest for the two suspects in the US as part of kick-starting this case, which has dragged on for one year,” he said.

Magistrate Declines Arrest Warrants

However, Naivasha Chief Magistrate Abdulqadir Ramathan declined to issue the warrants after the defence assured that the two suspects would appear in court on December 17, 2025.

The magistrate explained that extradition is a lengthy procedure and warned the victims that they should not take their complaints to the streets. He recalled that the previous protests had forced another magistrate to recuse himself from the case.

“This matter will be held in an open court and not in the streets, and I shall not tolerate any protests or contempt of court during the period,” he cautioned.

Murder Plot Linked to Family Land Feud

Court documents paint a chilling picture of the alleged murder plot. Investigators claim Muya, with the help of his daughter and son-in-law, planned to eliminate his wife and children to take over a prime piece of land in Molo town.

The documents allege that the plan began on March 1, 2024, when Muya and his daughter met two hired killers at a hotel in Nakuru. They allegedly agreed on a fee of Ksh3.1 million.

The prosecution says the money was arranged by the father and daughter, while the daughter – who lives in the US – flew back home as the plot unfolded.
