Senator Hezena Lemaletian Says No Case Dropped as Court Issues Permanent Restraining Order

Senator Hezena Lemaletian has issued a warning against false and unverified reports circulating on a local Samburu social media page, clarifying that the case regarding threats to her safety has not been dropped.

 According to Lemaletian, the timing of the post is suspicious and may be a scheme to divert attention from the report she made of threats posed against her life. 

“I must make something clear. In the same breath, the timing of that post needs to be investigated as the perpetrator could be joined at the hip,” Lemaletian said in regard to the news posting.

Court Action and Restraining Order

The ongoing harassment, Lemaletian explained, necessitated legal action against someone who she claims repeatedly contacted her using over 45 phone numbers and allegedly misused her name to con people around Nairobi and publish false information about the senator.

In addition to publishing false information, the perpetrator allegedly claimed to own a hospital in Maralal, using forged directorship documents. The legitimate hospital owners have since taken decisive measures against him.

Following a thorough legal process, Lemaletian successfully obtained a permanent restraining and protection order against the accused person. The court order, filed under Mcfc E102 /2025 before Hon. Terer Swiga/Timothy, prohibits the accused from assaulting, threatening, harassing, or interfering with Lemaletian’s safety.

Despite the order, Lemaletian said the accused continues to contact her, signalling non-compliance. She added that the second phase of her case, which includes defamation and related charges, has recently begun.

Concerns Over Social Media Abuse

Lemaletian said that people are misusing social media to circulate false information, which tarnishes her image without a proper verification process to ensure that the information about her is viable.

“It must be noted that it is illegal to publish lies and unverified information, especially on issues that are still in court,” Lemaletian said.

“I have restrained myself from commenting publicly, but continued media attacks may force me to reveal more than necessary.”

Lemaletian warned that she will not tolerate ongoing harassment or false information, and that further legal measures are imminent, as the accused has refused to comply with the restriction order, which directly states that the defendant should cease and desist from spreading false or defamatory statements against the plaintiff by any means.
