The FGR statement follows President Claudia Sheinbaum’s renewed questioning of the U.S. version of events regarding the arrest of Ismael 'El Mayo' Zambada.

Attorney General Ernestina Godoy announced that Ken Salazar, the former U.S. Ambassador to Mexico, may have committed irregularities in the 2024 kidnapping and subsequent transfer of drug trafficker Ismael 'El Mayo' Zambada to the United States. She specified during a press briefing that the diplomat said the U.S. had no part in the security operation, attributing responsibility entirely to the Sinaloa Cartel.

"We are witnessing a serious violation of the duties, prohibitions, and limitations of a diplomat," she stated.

She explained that investigations will continue, and that if it is confirmed to have been an operation orchestrated by the Federal Bureau of Investigation (FBI), it would constitute serious violations of both Mexican and international law.

"By no means does this imply or entail any allegation or presumption that, by lying, Ambassador Ken Salazar was automatically assuming the status of accomplice or co-responsible party in what is now presumably being evidenced as an operation by the U.S. agency, the FBI," detailed Godoy Ramos.

"What Ambassador Salazar is being accused of is conducting himself with falsehood; by virtue of the foregoing, he violated, contravened, and attacked the legal framework," she stated.

Ken Salazar violated the United Nations Charter

The head of the FGR’s Specialized Prosecutor's Office for Competency Control (FECC), Raúl Armando Jiménez Vázquez, stated that the former ambassador violated Article 2 of the United Nations Charter.

"And I am referring to the Vienna Convention on the Law of Treaties and, naturally, he violated the prohibitions of the 1961 Vienna Convention on Diplomatic Relations, such that we are in the presence of a case of serious violation of the duties, prohibitions, and limitations of a diplomat in our country."

The Special Prosecutor for Competency Control confirmed that, since August 14, 2024, information has been requested regarding the alleged kidnapping and transfer of the drug trafficker to U.S. territory, and revealed that, of 11 requests, only six have received a response.

Jiménez Vázquez confirmed, without providing details due to existing legal constraints, that this Wednesday morning a new request for international legal assistance was formally sent through the FGR office in Washington to the U.S. Department of Justice. The purpose of this request is to ask U.S. authorities to provide data that will allow for the integration of files related to the new information provided regarding the possible participation of FBI "operatives" in the planning, organization, capture, transfer, and cover-up.

Complex Investigation: The Case of the Kidnapping of "El Mayo" Zambada

Ernestina Godoy Ramos provided a chronological report of the events and acknowledged that the case of the kidnapping of "El Mayo" is a highly complex investigation, highlighting that it involves a series of potential serious violations.

"Everything points to the fact that we are facing three serious situations: a series of violations of Mexican and international law, a pact outside the bounds of the law, and a lie by a U.S. diplomat, which signifies a transgression of the foundational principle of good faith in diplomatic relations, as provided for in various international treaties."

Godoy Ramos highlighted that, in light of this scenario, the FGR is already conducting new investigative actions. She reiterated that a series of information requests have been filed through the international legal assistance mechanism, in accordance with the provisions of the bilateral treaty on the matter, for the United States government to provide information related to the aforementioned events.

The investigation incorporates the homicide of politician Héctor Melesió Cuén Ojeda, the kidnapping of Ismael “El Mayo” Zambada, the disappearance of two of the drug trafficker's bodyguards, and charges related to the administration of justice due to the tampering with the crime scene and various ministerial negligences at the state level.

Godoy Ramos stated that the pilot of the aircraft involved in the case has already been identified, and it has been confirmed that their identification documents had been altered.

Likewise, the Attorney General confirmed that there are 32 ongoing investigations in Mexico against Ismael “El Mayo” Zambada, each with valid arrest warrants, which has allowed for the formal request of the drug trafficker’s extradition from the United States government.
