Samidoh Sued in Kenya After Alleged Rape Incident in America

Kikuyu benga musician and ex-police officer Samuel Muchoki, popularly known as Samidoh, is facing a court battle after a woman identified as MRW accused him of rape during his music tour in the United States in 2021.

In a petition filed before High Court Judge Lawrence Mugambi, MRW not only named Samidoh as the Interested Party but also listed the Inspector General of Police, the Director of Criminal Investigations (DCI), the Director of Public Prosecutions, the Attorney General, and the Witness Protection Agency as respondents. She accused the state agencies of failing to act on her complaint against the musician, despite her repeated efforts.

Her lawyer, Sunday Memba Mayama, told the court that MRW continues to suffer ongoing violations of her rights due to the state’s inaction. He further raised concern that critical digital evidence may be tampered with or lost, and warned that the former police officer could interfere with or intimidate her and potential witnesses.

“The subject of the petition is a sexual offence apparently committed by the Interested Party, a Kenyan citizen, abroad, which by operation of Section 41 of the Sexual Offences Act, No. 3 of 2006, is triable in Kenya as if committed within its territory. Delay in action by the Respondents undermines the Petitioner’s protection under the Constitution and frustrates enforcement of the statute,” argued Memba.

The lawyer says MRW has kept audio recordings which are reported to capture Samidoh confessing to incriminating truths. He added that the longer authorities take, the higher the chances of the evidence being manipulated or deleted.

Petitioner Recounts Alleged Rape During US Tour

In her supporting affidavit, MRW recounted the purported attack, that on November 28, 2021, when Samidoh was in the US to perform at a concert, he invited her into his Airbnb in Overland Park, Kansas, where he raped her.

“I resisted and pleaded with him to stop, but he mocked my protestations, ignored my pleas, and without my consent whatsoever committed the horrific sexual offence,” she claimed.

She also alleged that between 2021 and 2023, the artist stayed in touch with her through communications which were a see-saw of pretentious friendliness and blatant threats. One day, after she had confronted him over the incident, he allegedly called her a “professional prostitute.”

MRW reported the incident to the Overland Park Police Department in Kansas, who reported it as Case No. 2023022021 under rape. She also underwent therapy and psychological counseling. Her therapist issued a letter on June 5, 2025, which said she suffers from symptoms of trauma consistent with sexual assault.

Despite the fact that she had reported to the Kansas District Attorney’s Office in November 2023, she told the court that the case has not reached trial or conviction. She also reported a case to the DCI in Kenya in June 2025, but said police did not register or investigate her complaint, nor move to collect evidence from the US.

Court Asked to Compel DCI and Witness Protection to Act

As part of the petition, she seeks an order requiring the DCI to collect and keep all evidence. She further seeks restraining orders prohibiting Samidoh from directly or indirectly contacting her using members of their families, friends, associates, or colleagues.

MRW is also seeking a directive requiring the Witness Protection Agency to carry out an assessment and put protective measures in place.

“Unless this Honourable Court intervenes urgently, there is a real risk that I will continue to suffer violation of my rights, that critical evidence will be lost, and that I will remain exposed to harassment and intimidation by the Interested Party,” she told the judge.
