Nairobi Landlords in 27 Estates Given Ultimatum to Install Safety Signals

The Kenya Civil Aviation Authority (KCAA) has issued a public notice to at least 27 Nairobi landlords and property owners on the legal construction and safety requirements for developments near aerodromes.

In a statement on February 3, KCAA asked developers to comply with the aviation safety regulations.

“No person shall construct, erect, or alter any building or structure within the vicinity of an aerodrome, defined as a radius of fifteen (15) kilometres from the aerodrome, without prior written authorization from the Authority,” said KCAA Director General. 

The directive is contained in a public notice issued pursuant to Section 57 of the Civil Aviation Act (Cap. 394), Laws of Kenya, and the Civil Aviation (Aerodromes) Regulations, 2013.

In addition, the authority noted that no person is permitted to construct or alter any structure or building within a radius of 15 kilometers from an aerodrome without prior written authorization from the DG.

Developers and property owners must submit applications to the Authority for review and approval of acceptable building heights before commencing any construction.

KCAA regulations

In accordance with Regulation 72 of the Civil Aviation (Aerodromes) Regulations, 2013, all developments and buildings within the aerodrome vicinity must be marked and fitted with class B medium-intensity aeronautical obstacle lights, which are aviation safety installations for visibility.

Technical specifications and installation guidance are provided in Advisory Circular CAA-AC-AGA-032 on the Lighting and Marking of Obstacles, issued by the authority, which states that the lights are installed either at the tips of aerial masts or at the four upper extremities of buildings or structures.

As the regulations apply to all developments around all international and domestic aerodromes in Kenya, the notice highlights specific areas near Wilson Airport.

Compliance Ultimatum

These areas, which fall within a fifteen-kilometer radius of the airport, include Nairobi West, Madaraka, South B, South C, Nairobi Dam, Ngummo, Highview, Magiwa, Golf Course, Langata Estates, Karen, Southlands, Otiende, Ngei 1 and 2, Onyonka, Masai, Uhuru Gardens, Jonathan Ngeno, Deliverance, Dam Estate, Ngong Road, Kibera, Highrise, Ongata Rongai, and Kabete.

Also, the authority gave property owners, lessors, and lessees of these areas within a 15-kilometer radius of developments thirty (30) days to install the required standard Class B medium-intensity obstacle lights.

Accordingly, failure to comply with the requirements of the Civil Aviation Act and the Civil Aviation (Aerodromes) Regulations, 2013 will result in enforcement action and legal action in accordance with the law.

The KCAA notice aims to ensure that aviation and public safety are maintained while managing developments around aerodromes in Nairobi and across the country.
