The concept of writing wills among Kenyans has grown, becoming a norm in recent years, especially among the wealthy.

Although meant to bring harmony after one dies, some wills have been unusual, with some causing battles that have ended with only a few benefiting.

From some leaving out their loved ones, especially wives, to others leaving a chunk of their properties to in-laws, billionaires have taken steps to ensure their wishes are honored, despite some causing controversy.

This has seen some leave a share of their properties to unusual beneficiaries, and a good example is the late former Cabinet Minister Nicholas Biwott. Times Digital Kenya takes a look at Biwott’s will, which left out three of his four wives.

How Biwott’s wealth was distributed

Throughout his lifetime, Biwott, famously known as the “Total Man,” lived a controversial life, and his wealth remained a mystery.

Even after his death in 2018, controversy seemed to follow him, as his will did not in any way give a glimpse of his wealth.

Having been named among the top 50 richest African people in 2013 with a net worth of Sh100 billion, the assets he distributed in his will did not reach that amount, making it even more controversial.

Not only did Biwott fail to disclose how much he held in partnerships and who his partners were, but he also did not list any of his investments in other sectors.

After his death, it emerged that he had given an equal one-fourteenth share of his life estate to all his children. Additionally, trustees were to keep a one-fourteenth share of his estate in trust for his grandchildren.

Surprisingly, in the will, Biwott stated that three of his four wives would not receive any of his wealth. He detailed that only one of his wives, Johanna Catherina Kiprono Biwott, who was managing a portion of his property, would keep it exclusively hers.

“I am married to Johanna Catherina Kiprono Biwott by virtue of a civil marriage ceremony and any assets held in her name or held by any person upon trust for her are hers exclusively.” — Nicholas Biwott.

For people with whom he was a joint owner of assets, Nicholas Biwott stated in his will that upon his death, all his share, rights, and interests would be transferred.

All in all, Sh10 million was set aside for the maintenance of his grave and another Sh50 million was allocated to Mbegu Trust, a charity organization he set up.
