The High Court has issued restraining orders barring DCI officers from arresting Democratic for Citizens Party (DCP) Deputy Party leader, Cleo Malala.

On the evening of August 12, the High Court granted former Kakamega senator Cleo Malala orders barring police officers from arresting him. The DCP deputy party leader faces arrest over a controversial helicopter landing at Mumias Sports Complex during the KSSA finals.

Cleo Malala has been a wanted man since making a landing using a helicopter at the center of a stadium during school games. The vocal politician showed up during the final match between Musingu Boys and St. Joseph Boys Kitale.

His dramatic entry into the event was described as a breach of national security that endangered lives. Just over a week ago, Malala was summoned to appear before the DCI offices in Kakamega to answer questions related to the issue.

Now, the former Kakamega senator has secured a court order stopping his impending arrest. DCP party lawyer Wakili Edgar Busiega obtained orders from the High Court of Kakamega County.

“This afternoon, the lawyer representing the Democracy for Citizens Party, Wakili Edgar Busiega (DCP Party’s Malava Constituency Candidate in the forthcoming by-election), obtained interlocutory orders barring DCI officers from arresting me on allegations of landing a helicopter at Mumias Sports Complex during the KSSA finals,” Malala said on Facebook. According to the petition, the summons issued to the former senator did not meet due process requirements. Additionally, the petition stated that comments made by some officials risked creating a perception of prejudgment.
