Justice Daniel Osiagor of the Federal High Court in Lagos has granted an applicant seeking leave to serve the Inspector General of Police (IG) and the Deputy Inspector General of Police (DIG), Force CIID, Area 10, Abuja in a fundamental rights enforcement suit filed by a lawyer, Mr. Kola Sodiya.

 Justice Daniel Osiagor made the order  in Suit FHC/L/CS/1778/2023 filed by Sodiya. The first to eighth respondents in the suit include the IG,DIG, Force CIID, Area 10, Abuja, the AIG Annex, Force CIID Annex, Ikoyi, Lagos and the AIG Zone 2, Onikan. The others are SP Usidamen Odion, Adeleke Sunday, Sile Omonivi and Adebayo Elebanjo.

The judge in his Ruling held “After hearing Kola Sodiya appearing in person for the Applicant move in terms of the  Motion paper.

“It is hereby ordered as follows “That leave is granted to the Applicant herein to serve the Motion on Notice, Statement filed Pursuant to Order 2, Rule 3 of the Fundamental Rights (Enforcement Procedure) Rules 2009, Affidavit in Support, Written Address all dated 4th September, 2023 and all other court processes in this suit on the 4th Respondent through the Officer in Charge (O/C) Legal Department, Nigeria Police Zonal Command, Zone 2, Onikan, Lagos.

“That leave is granted to the Applicant herein to serve the Motion on Notice, Statement filed pursuant to Order 2, Rule 3 of the Fundamental Rights (Enforcement Procedure) Rules 2009, Affidavit in Support, Written Address all dated 4th September, 2023 and all other Court processes in this Suit on the 7th Respondent by pasting at Number 97, Okemu Street, Oworonshoki, Lagos being the last known place of abode of the 7” Respondent.

“That leave is granted to the Applicant herein to serve the Motion on Notice, Statement filed pursuant to Order 2, Rule 3 of the Fundamental Rights (Enforcement Procedure) Rules 2009, Affidavit in Support, Written Address all dated 4th September, 2023 and all other Court processes in this Suit by posting same at the last known address of the 8th Respondent’s Lawful Attorney (Mr. Afolabi Saheed Odunewu’s) address at Plot 379e, George Crescent, off Wempco Road, Agbalajobi Estate, Ogba, Lagos State.

“That the 5th Respondent S. P. Odion is to appear in Court personally on the next adjourned date to answer to the allegations of the Applicant.

“That the case is adjourned to the 7th of November, 2023 for Report of Service/Hearing
