Kalonzo Musyoka Sues Ruto’s Govt

Wiper party leader Kalonzo Musyoka has filed a petition to block the Jomo Kenyatta International Airport (JKIA) takeover by the Adani Group.

The Azimio co-principal on Monday, September 23 filed the petition on the High Court of Kenya at Milimani in Nairobi.

Kalonzo filed a joint petition with Azimio constituent parties namely, Wiper Democratic Movement Party, Kenya Africa National Union (KANU), Democratic Alliance Party of Kenya (DAP-K), and the Jubilee party.

In a statement, Kalonzo said he had visited the court in the morning, and they were granted a hearing on October 17.

Kalonzo’s statement on the petition

“As stated in Kajiado yesterday, I attended High Court this morning in the matter of the illegal alienation of Jomo Kenyatta International Airport which is a strategic government asset against the Adani Group, “Kalonzo stated.

The respondents in the case include Adani Group, The Managing Director of Kenya Ports Authority, the Cabinet Secretary (CS), The National Treasury and Economic Planning, John Mbadi, CS Roads and Transport, Davis Chirchir, and the Attorney General.

Interested parties in the case include the Kenya Civil Aviation Authority, Kenya Aviation Workers Union, and the Kenya Airline Pilots Association.

At the same time other petitioners in the JKIA – Adani Takeover include veteran journalist Tony Gachoka and Mount Kenya Jurist.

Other Petitioners besides Kalonzo

Gachoka and Mt Kenya Jurist through their lawyer Ndegwa Njiru argue that the deal is floored with illegalities, and it was never subjected to public participation, yet JKIA is a strategic national asset.

However, the Adani Group has defended itself on the takeover matter, arguing that the current cases filed in court are ill-timed as the deal is still at the review and due diligence stage.

In a response to a separate case filed by the Law Society of Kenya and Kenya Human Rights Commission, Alok Patni, a representative of Adani Airports Holdings Limited says most of the information contained in the current case is false.

According to reports, the government leased the JKIA airport to the Adani Group for 30 years and the Adani group has so far dismissed the claims and insists a deal has not been struck yet.

The JKIA-Adani takeover has faced public uproar from a section of Kenyans, with Kenyan aviation workers recently downing their tools and demanding to be included in the airport lease negotiations.
