How to Get Govt Clearance for Jobs in Saudi Arabia And Qatar

Kenyans seeking job opportunities in Saudi Arabia and other foreign countries must now ensure their contracts are authenticated by the Department of Labour before departure — a process officially known as Foreign Contract Attestation.

According to the Ministry of Labour, the attestation process is designed to protect migrant workers from exploitation and ensure that their rights and welfare are safeguarded while they work abroad.

The exercise involves the authentication of a foreign job contract by a designated Labour Officer prior to travel.

Why Kenyans Get Their Foreign Job Contracts Attested

The government verification process helps ensure that every Kenyan traveling for employment is adequately protected and can be repatriated in the event of an emergency.

It also provides a legal framework to prevent abuse, fraud, or coercion during overseas employment.

The attestation ensures that a worker’s consent is freely given, that the contract meets the standards set under the Employment Act 2007, and that the employee understands the terms and conditions of service.

Role of the Labour Officer

Labour Officers are tasked with verifying that the contract is genuine, compliant with Kenyan labour laws, and that the worker is medically fit for the job.

They also ensure that the employee is not already bound by another contract during the same period.

A contract can only be attested if the officer is satisfied that it fully complies with Section 83 of the Employment Act 2007 and other relevant labour regulations.

Requirements for Attestation

Migrant workers are required to present several documents during the attestation process, including:

  • Duly filled prescribed forms
  • Form of Foreign Contract of Service (LD21)
  • Bond Form – issued by the employer as security to the Government of Kenya, ensuring accountability in case of contract breach
  • Attestation Details and Employee Terms and Conditions
  • Medical Certificate – confirming fitness for work
  • Employment Contract – for domestic workers heading to Saudi Arabia, this must be generated through the MUSANED system
  • Offer Letter – for those migrating to Qatar, which must be endorsed by the Labour Attaché to confirm the existence of the job

Penalties for Non-Compliance

The Ministry warns that failure to obtain proper attestation is a criminal offence under Section 86 of the Employment Act, 2007.

Offenders risk a fine of up to Ksh200,000, a six-month jail term, or both.

This legal requirement underscores the government’s commitment to safeguarding Kenyans working abroad and ensuring ethical labour practices by foreign employers.
